Receiving a denial letter after applying for Social Security Disability Insurance (SSDI) in Connecticut can feel discouraging, especially if your disability significantly limits your ability to work. However, a denial is not the end of your claim. The Social Security Administration (SSA) offers a structured appeals process that gives you multiple opportunities to secure the benefits you need.
Find out if you qualify for SSDI benefits. Pre-qualify in 60 seconds for up to $4,018 per month and 12 months back pay.
Please answer a few questions to help us determine your eligibility.
1. Understand Why Your Claim Was Denied
Before appealing, carefully review your denial letter to understand the SSA’s reasoning. Common reasons for SSDI denial include:
- Lack of sufficient medical evidence to prove your condition
- The SSA determined you can perform past work or other work
- You did not meet non-medical eligibility requirements (e.g. insufficient work credits)
Knowing why you were denied allows you to target these weaknesses in your appeal.
2. File Your Appeal Promptly
You must file your appeal within 60 days of receiving your denial notice. Missing this deadline can force you to restart your application, delaying benefits significantly.
3. The Four Levels of SSDI Appeals
A. Reconsideration
- What it is: A complete review of your initial application by a new SSA examiner
- How to file: Submit Form SSA-561 (Request for Reconsideration) online at ssa.gov or at your local SSA office
- Include additional evidence: Submit any new medical records, test results, or documentation that supports your disability claim
B. Administrative Law Judge (ALJ) Hearing
- If reconsideration is denied: You can request a hearing before an ALJ
- What to expect: A formal hearing where you (and your attorney, if you have one) can present evidence and testimony
- How to prepare:
- Review your entire claim file
- Obtain updated medical records and doctor’s opinions
- Prepare your testimony about how your condition limits your daily activities and ability to work
C. Appeals Council Review
- If the ALJ denies your claim: You can request a review by the SSA Appeals Council
- Role of the Appeals Council: They will review your hearing decision to determine if the ALJ made errors in applying the law or evaluating your evidence. They may uphold, reverse, or remand the decision for another hearing.
D. Federal Court Review
- Final option: If the Appeals Council denies your request or upholds the ALJ decision, you can file a lawsuit in U.S. District Court
- Legal representation recommended: At this stage, it is highly recommended to work with an attorney experienced in federal disability appeals.
4. Strengthen Your Appeal with Strong Evidence
To improve your chances of winning your SSDI appeal in Connecticut:
- Gather updated medical records: Including recent doctor visits, test results, hospitalizations, and treatment plans
- Obtain a detailed doctor’s opinion: A medical source statement explaining how your condition limits your ability to perform work tasks
- Include statements from family or caregivers: Describing your daily challenges and limitations
- Stay compliant with treatment: Continue following your doctor’s recommendations to show you are doing everything possible to manage your condition
5. Don’t Give Up After a Denial
Many SSDI claims are initially denied but are later approved during appeals when
stronger evidence and strategic legal arguments are presented. Persistence is often key in the SSDI process.
